Who acts as the controller of your personal data?

The following entity acts as the controller of personal data collected via the moto-gama.com.pl website (hereinafter: the Controller), i.e., as the entity in charge of ensuring security of your personal data:

For what purposes and for how long do we process your personal data, and with whom can we share them?

  4. used to protect your rights as a party to a contract, for example, to handle a complaint you have made;
  5. used for marketing purposes, e.g., to send you our business information (this does not apply to persons under the age of 18) – you will only receive such information by e-mail if you have consented to this (this also applies to persons under the age of 18);
  6. used to issue sales documents;
  7. kept in our records (in electronic or paper format) to draw up contracts as well as accounting and tax documents;
  8. transferred to the following entities: our subcontractors, companies providing marketing, IT, profiling, accounting, legal, debt collection, payment, banking services to us and others supporting our business and requiring such transfer;
  9. used for establishing, defending and seeking legal redress of your or our claims;
  10. used to make compilations, analyses and statistics for our internal purposes, including in particular reporting, marketing research, planning the development of sales of goods and services, development work in IT systems, and creation of statistical models.

We may process your data for the above mentioned purposes as this proves necessary for the fulfilment of our legal obligations (e.g., settlement with contractors, tax obligations), for our marketing and statistical activities, which is in our economic interest, as well as for defending our rights under the contract concluded with you.

We will delete the above data 3 months after the last purpose of their processing ceases to apply. In the meantime, we will cease to process them for the following purposes on the following dates:

  1. data serving the purpose of performing a contract ‒ within 3 months after the contract has been completed or terminated;
  2. data serving the purpose of fulfilling our legal obligation ‒ within 3 months after the obligation has ceased to apply;
  3. data stored with the aim of defending our legal interest ‒ within 3 months after the legal interest has ceased to apply; however, data serving the purpose of establishing, defending and seeking legal redress of your or our claims shall cease to be processed within 3 months after the expiry of the statute of limitations for your claims or within 3 months from the expiry of our claims, whichever is the later;
  4. data serving the purpose of our marketing activities ‒ within 18 months of their last use (this does not apply if you have given your explicit consent to the processing of your personal data for marketing purposes);
  5. data serving the purpose of exchanging correspondence on specific matters ‒ within 3 months of the last correspondence exchanged on that matter;
  6. data serving the purpose of providing you with commercial information by electronic means (where you have given your consent) ‒ within 60 months of the last contact with you.

Your personal data collected from other sources

If you or we make a payment (e.g., in respect of an invoice) through, for example, a bank or payment institution, we will come into possession of information about the account and institution to which or by hand of which you or we ‒ as the case may be ‒ have made that payment. We will process such data in order to check whether the payment was made correctly, as well as to record and settle the payment and to make the necessary refunds, if any.

We may also obtain your data from publicly available registers, records, etc., for the purposes described above (conclusion/performance of a contract, fulfilment of statutory accounting/archiving obligations, assertion or defence against your claims or claims brought by third parties, marketing or exchanging correspondence with you). This means that, in some cases, we will be able to refuse the request. In such cases, we will explain to you the reasons for our decision, along with indicating the legal basis for it. Right to object
